In this paper I will outline a basic guide to how discrimination in the workplace is proven. Each case is different, and this basic guide may not apply to every case. Title VII of the Civil Rights Act of 1964 prohibits discrimination in employment of companies engaged in interstate commerce. States also have non-discriminatory laws covering companies engaged in intra-state commerce. Recent court decisions have made proving discrimination in the workplace complicated. However, this guide is still a good reference in determining if an employee or group of employees has been discriminated against in the workplace.
The Employee’s Position:.
The first step is to determine the employee’s position. The employee should be able to show that he/she is a member of a protected class”, and they suffered an adverse employment action.” Not all discrimination is prohibited. In order to be protected from discriminatory employment practices, a person must prove that he/she is a member of a protected class, and that the discrimination is because of their protected class status.
